Terms and Conditions for Making Donations

I. General Provisions

  1. These Terms and Conditions set out the rules governing the making of monetary donations via the Mushika Foundation’s website, as well as the rules governing the use of the online service enabling donations to be made towards the Foundation’s statutory purposes.
  2. The website administrator and service provider is the Mushika Foundation, with its registered office in Włoszczowa (registered address: 29-100 Włoszczowa, ul. Jędrzejowska 79C), entered in the Register of Associations, Other Social and Professional Organisations, Foundations and Independent Public Healthcare Institutions of the National Court Register by the District Court for Katowice – East in Katowice, 8th Commercial Division of the National Court Register, under KRS number 0001105272, Tax Identification Number (NIP): 6343039499, represented by Katarzyna Wypychewicz – Chairwoman of the Foundation, hereinafter referred to as the “Foundation”.
  3. A donor is any natural person, legal person or organisational unit with legal capacity who makes a donation via the Foundation’s website.
  4. Donations made via the website constitute donations within the meaning of Article 888 et seq. of the Civil Code and are allocated to the fulfilment of the Foundation’s statutory objectives.
  5. Making a donation is voluntary and does not entail the Donor receiving any consideration in return from the Foundation.
  6. By using the donation form, the Donor declares that they have read these Terms and Conditions and accept their provisions.
  7. The current version of the Terms and Conditions is always available on the Foundation’s website.

II. Rules on making donations

  1. Donations can be made using the form available on the Foundation’s website.
  2. Funds transferred to the Foundation are used to achieve its statutory objectives, in particular those relating to:
  3. ecology and animal welfare;
  4. the protection of natural heritage;
  5. fostering appropriate social attitudes towards the animal world;
  6. preventing animal homelessness;
  7. conducting educational activities;
  8. supporting non-governmental organisations whose objectives are consistent with those of the Foundation;
  9. the administration of grant schemes;
  10. other activities aimed at achieving the Foundation’s statutory objectives.
  11. Electronic payment services are provided by PayU S.A., with its registered office in Poznań (60-166), at 186 Grunwaldzka Street, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000274399, NIP 7792308495, REGON 300523444, hereinafter referred to as the “payment operator”.
  12. The detailed terms and conditions governing the provision of payment services are set out in the terms and conditions of the payment service provider PayU S.A., which are available on the payment service provider’s website.
  13. Donations can be made using the payment methods provided by the payment provider, in particular:
  14. electronic bank transfer;
  15. payment card;
  16. BLIK;
  17. mobile payments;
  18. other methods offered by the payment provider.
  19. The connection to the payment form is secured by an SSL certificate.
  20. A donor may donate:
  21. a one-off donation;
  22. a regular (recurring) donation, if this feature is available.
  23. Donors may choose from the suggested amounts or decide on the amount of their donation themselves.
  24. Confirmation of the donation is provided by the payment confirmation generated by the bank or payment provider.

III. Regular donations

  1. A regular donation involves the Donor transferring a chosen amount to the Foundation each month.
  2. Recurring payments are processed via the payment provider in accordance with the rules set out in its terms and conditions.
  3. Payment card details are not stored by the Foundation. These details are processed exclusively by the payment provider.
  4. If an attempt to debit funds is unsuccessful, the payment service provider may retry the transaction in accordance with its own procedures.
  5. A donor may cancel their regular donation at any time by contacting the Foundation or – if the payment provider offers this option – directly through the payment provider.
  6. The cancellation takes effect from the next scheduled debit from your account or card.

IV. Tax deductions

  1. Donations made to the Foundation may be deductible from the tax base in accordance with the applicable tax legislation.
  2. Donors should retain a document confirming that the donation has been made, in accordance with the applicable regulations.

V. Complaints

  1. In the event of any issues relating to making a donation, the Donor may submit a complaint by email to: info@mushika.pl.
  2. A complaint should include:
  3. full name;
  4. e-mail address;
  5. the date on which the payment was made;
  6. the amount of the donation;
  7. Description of the problem.
  8. The Foundation will consider the complaint within 14 days of receiving it.
  9. Complaints regarding the operation of the payment system may also be submitted directly to the payment operator in accordance with its terms and conditions.

VI. Refund of a donation

  1. A donor may, by means of a reasoned request, ask for the return of a donation made in error or as a result of an obvious mistake.
  2. The application must be sent to the Foundation’s email address no later than 14 days after the payment has been made.
  3. The Foundation reserves the right to verify the circumstances set out in the application before deciding whether to refund the donation.
  4. Each application is considered on a case-by-case basis, taking into account the circumstances of the case.
  5. If the application is approved, the funds will be refunded within 14 working days.

VII. Personal data

  1. The Mushika Foundation is the data controller for Donors’ personal data.
  2. Personal data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), the Personal Data Protection Act and the Foundation’s Privacy Policy.
  3. The data is processed for the following purposes:
  4. making a donation;
  5. keeping accounting records;
  6. to fulfil obligations arising from the law;
  7. contact with the Donor;
  8. carrying out statutory activities and communicating with Donors, solely to the extent permitted by applicable law and the consents granted.

VIII. Final Provisions

  1. These Rules and Regulations shall come into force on the date of their publication on the Foundation’s website.
  2. The Foundation may amend the Rules and Regulations for valid reasons, in particular in the event of:
  3. changes to the law;
  4. change of payment provider;
  5. changes to the way donations are made;
  6. the development of the website’s functionality.
  7. Amendments to the Rules and Regulations do not affect donations made before the date on which they come into force.
  8. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services, the Act on Public Benefit Activity and Voluntary Work, and the provisions concerning the protection of personal data.
